These terms govern your use of HEAVY, the rucking coach app. By downloading or using HEAVY you agree to them. If you don't agree, don't use the app.
Rucking means walking under load. It is real physical training, and like all training it carries real risk of injury.
HEAVY's coaching — daily load suggestions, rest days, benchmarks, zones — is general fitness information computed from your data. It is not medical advice, and HEAVY is not a medical device. Talk to a doctor before starting any training program, especially if you are new to load carriage, returning from injury, pregnant, or managing a medical condition. Stop immediately if something hurts. You alone decide what to carry and how far to walk, and you use HEAVY at your own risk.
HEAVY grants you a personal, non-exclusive, non-transferable license to use the app on Apple devices that you own or control, as permitted by the App Store terms. The app, its design, and its content belong to HEAVY and are protected by law. Don't copy the app, resell it, reverse-engineer it, or use it to build a competing service.
HEAVY is a paid app with an auto-renewing subscription (monthly or yearly). All billing is handled by Apple, not by HEAVY:
HEAVY creates an anonymous account so your training log can back up. What is collected and how it is handled is described in the Privacy Policy, which is part of these terms. You can export your log or delete your account and everything in it at any time from inside the app.
Features that share anything — the weekly leaderboard, squads, the live beacon — are off until you turn them on. Where you appear to others under a callsign, keep it decent:
You can block or report another operator directly from the board.
HEAVY measures with the sensors your phone and watch provide. GPS, motion and heart-rate data have inherent limits; where measurement is weak the app says so rather than guessing. Numbers in HEAVY are training information, not certified measurements, and shouldn't be relied on where precision has legal or safety consequences.
HEAVY is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose. We work to keep the app accurate and the service up, but we don't promise it will be uninterrupted or error-free.
To the maximum extent permitted by law, HEAVY and its developer are not liable for indirect, incidental, special, or consequential damages — including injury arising from training decisions, lost data, or lost profits — arising from your use of the app. Where liability cannot be excluded, it is limited to the amount you paid for the service in the twelve months before the claim. Nothing in these terms limits liability that cannot lawfully be limited.
You can stop using HEAVY and delete your account at any time. HEAVY may suspend or terminate access for breach of these terms. Sections that by their nature survive — disclaimers, limitation of liability — survive termination.
If these terms change in a way that materially affects you, the app will say so rather than quietly updating this page. Continuing to use HEAVY after a change takes effect means you accept the updated terms.
These terms are between you and HEAVY, not Apple. Apple has no obligation to provide support for the app and is not responsible for it, but Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
